User Agreement / Terms of Use

This website is owned and operated by For Sale By Veteran LLC, a Georgia Limited Liability Company. In this User Agreement, the terms “For Sale By Veteran,” “FSBV,” “company,” “we,” “us,” and “our” refer to the use of the ForSaleByVeteran.com website and For Sale By Veteran, LLC. and the terms “you,” “your,” “Active-Duty,” “Veteran,” “Veteran/Active-Duty,” and “Civilian” refer to you as a user of our website, mobile and other online applications and products and services (collectively, the “For Sale By Veteran Site”). The term “Vehicle” and “Vehicles” refer to cars, trucks, SUV’s, motorcycles, boats, RV’s and any other motorized vehicle that someone may choose to post on the For Sale By Veteran site. The term “Home,” “Homes,” “Apartment,” or “Apartments” refers to a residence that someone may choose to post on the For Sale By Veteran site.
General Requirements
By using the For Sale By Veteran Site, you accept the terms of this User Agreement. This is a legally binding agreement between you and For Sale By Veteran LLC; please read it carefully. All terms and guidelines on the For Sale By Veteran site are part of this User Agreement and incorporated herein by reference. Unless stated otherwise, any features or services available at any time on the For Sale By Veteran site are subject to this User Agreement. Accessing the FSBV site in any manner constitutes your agreement to be bound by this User Agreement. For Sale By Veteran may change the terms of our User Agreement from time to time and will revise the effective date when we do. Your continued use of the For Sale By Veteran site after the posted effective date constitutes your agreement to be bound by this User Agreement as modified, except that modifications do not apply to any dispute arising prior to their effective date. For Sale By Veteran may change, restrict access to, suspend, or discontinue the For Sale By Veteran site, or any portion thereof at any time.
The material that appears on the For Sale By Veteran site is for informational purposes only. While we aim to provide a site that is useful, be mindful that the For Sale By Veteran site may, from time to time, contain errors. The For Sale By Veteran site includes materials and information collected from, and provided by, third parties that we may not have verified. We make no guarantees regarding the accuracy, completeness, timeliness, or reliability of any of the materials or information on the For Sale By Veteran site, and you should not rely on it without independent verification.
We ask you to bring to our attention any materials or information on the For Sale By Veteran Site that you believe to be inaccurate to our attention. Please forward a copy of the materials or information to our Tech Support, along with a brief explanation of the inaccuracy.
Listing Your Vehicle or Home
The For Sale By Veteran site offers several advertisement packages to Active-Duty Military personnel and Honorably Discharged Veterans. For information about the ad packages, click the “LIST MY VEHICLE” or the “LIST MY HOME” button on our home page. For information about ad packages available to dealers (and Veteran/Active-Duty who intend to list more than three (3) vehicles for sale or three (3) homes for sale or rent at a given time), please visit the For Sale By Veteran website and see the “Veteran Owned Dealers / Real Estate Agents” section at the bottom of the home page.
By offering a vehicle for sale through our service for Veteran/Active-Duty, you agree that, you are in possession of the listed vehicle, you are at least 18 years of age, you are able to legally transfer the title and you are prepared to sell your vehicle at the price and terms which you have listed it. To list a vehicle or home for sale or home for rent on FSBV, sellers are required to provide identification and contact information. By using the FSBV site, you agree to allow us to share your contact information with interested buyers in order for them to communicate with you and negotiate with you directly. FSBV will NOT be a party to negotiations.
When offering a home for sale or rent on the For Sale By Veteran site, we strongly encourages you to work with a licensed Real Estate agent in your area. You may still be permitted to post your listing if you aren’t working with a Realtor, however, For Sale By Veteran will NOT be a party to, NOR will we be responsible for, negotiations or any other part of the financial transaction, in any way. By listing a home for sale or rent on the FSBV site, you agree that, you are the party legally responsible for the home, you are in possession of the home, you are at least 18 years of age, you are able to legally transfer the ownership if you are listing the home for sale, you are able to legally rent the home if you are listing the home for rent and you are prepared to sell your home or rent your home at the price and terms which you have listed it. As with vehicles, homes listed for sale, or for rent, on the FSBV site are for informational purposes only. For Sale By Veteran LLC is not in the Real Estate business and we make no representation contrary to that fact. As a result, we do not conduct home appraisals, home inspections, title search or any other procedure ordinarily involved in a real estate transaction, in any way. Should you post an ad for a home, and you don’t have a Real Estate agent at that time, we highly recommend that you consider doing so and ask that you share that information with us.
Veteran Owned Real Estate Brokerages and Licensed Real Estate agents who are Honorably Discharged Veteran’s or Active-Duty Military may post homes for sale or for rent on the FSBV site. Should a Real Estate Broker or Real Estate Agent be interested in posting advertisements on the FSBV site, please visit the For Sale By Veteran website and see the “Veteran Owned Dealers / Real Estate Agents” section at the bottom of the home page.
Charging a potential buyer for information about any vehicle or home listed for sale or rent on FSBV is strictly prohibited.
By using the For Sale By Veteran website to list your vehicle as a private seller, you represent that you are not a vehicle dealer, that you are not listing a vehicle for sale in your capacity as a representative of a dealer, and that neither you nor anyone acting on your behalf will list more than three (3) vehicles for sale at any one time. A seller who wishes to list more than three (3) vehicles at any one time, and any dealership who desires the ability to list any vehicle, please visit the For Sale By Veteran website and see the “Veteran Owned Dealers / Real Estate Agents” section at the bottom of the home page.
Advertising more than one (1) vehicle or home per listing is prohibited. Your vehicle’s VIN, year, make or model cannot be changed once you purchase a listing. You alone are responsible for checking and re-checking the information before purchasing the listing. Listing fees are generally not refundable. As a result, if you enter an incorrect VIN, year, make or model, you will have to delete the advertisement and you would be responsible for purchasing a new listing if you wish to advertise the vehicle. If you enter any incorrect information on a home listing, you will have to delete the advertisement and you would be responsible for purchasing a new listing if you wish to advertise you home.
By using FSBV to list your vehicle for sale or your home for sale or rent, you agree to pay the price of the package as set on the Foro Sale By Veteran site, whether your vehicle sells because of the advertisement or not. You also agree that you are responsible for paying any applicable taxes relating to your use of the For Sale By Veteran service.
You alone are responsible for the accuracy of the material you submit to FSBV to be posted on your advertisement, including listing information and photos of your vehicle or home, and for the content of all email messages you transmit through the For Sale By Veteran site should we allow you to do so.
All listings are screened before being posted on the For Sale By Veteran site in an effort to prevent fraud and abuse. This process may delay the publication of your listing by as much as 48 to 72 hours. In the event that we cannot monitor every listing on the For Sale By Veteran website, we may, from time to time, perform random advertisement quality checks to confirm that those who offer vehicles or homes for sale over the FSBV siite are prepared to sell those vehicles or homes at the prices they are advertised. By using the For Sale By Veteran website, you agree to cooperate in these quality checks. Should we learn, through these checks or any other way, that a seller is violating the terms of this User Agreement, we reserve the right to deny that seller use of services offered on the For Sale By Veteran website with no refunds due.
By listing a vehicle or home for sale on the For Sale By Veteran Site, you agree to use the email addresses of those responding to your listing only to communicate with them about the potential sale of that vehicle.
By listing a vehicle or home for sale or home for rent on the For Sale By Veteran site, you warrant that: you are the author of the data, you are the owner of the photos used for the advertisement, or other material (“Content”) that you submit to For Sale By Veteran; you voluntarily waive all “moral rights” that you have in that Content; the Content you submit is not misleading. You agree that you will not: submit any Content that is, or may reasonably be considered to be, lewd or disrespectful. You also agree that you are not committing the act of Stolen Valor.
By listing a vehicle for sale on the For Sale By Veteran site, You provide For Sale By Veteran with a nonexclusive, royalty-free, perpetual, transferable, irrevocable, and fully sub-licensable license to utilize, reproduce, modify, adapt, translate, distribute, publish, create derivative works from, and publicly display or perform the provided content worldwide, across any existing or future media platforms.
You are always free to sell or trade-in your vehicle outside of FSBV.
Renewal & Refund Policy
Should your vehicle not sell in the time allotted for the Advertisement (30 Days for a Basic Ad or 90 Days for a Premium Ad), by purchasing an Advertisement on the site, this action signifies your approval to auto-renew your subscription and charge your card again 30 Days after the original charge for a Basic Ad and 90 Days after the original charge for a Premium Ad. This service is provided to assist you in keeping your vehicle on the FSBV site to let potential buyers know that your vehicle is still for sale. This action will happen only one time. Should your vehicle not sell after the second Ad time period, 30 Days or 90 Days, your Ad will be removed and you will be required to purchase and new Ad. To stop a recurring charge, you must notify the For Sale By Veteran Customer Service Department by email us at: customerservice@forsalebyveteran.com with a message in the Subject line such as: Re: “Remove my vehicle from the site” with a reason/description in the body of the email. Reasons could include, “My vehicle sold” or “I changed my mind and no longer wish to sell my vehicle” or any other reason. Be advised, cancellation emails received within 4 days of the date of the next charge (typically 30 or 90 days from the original charge) may not be processed in time and your card may be charged as a result. There is no refund for purchasing an Ad or the recurring charge. Your use of this site signifies your understanding of our policy stipulating that there is no refund under any circumstances. For Sale By Veteran will make every effort to connect with you via email and/or phone prior to the renewal period. But it is the sole responsibility of the user of the site to connect with us to prevent another charge or (should your Ad have already been renewed once) to prevent your Advertisement time lapsing which will result in the removal of your Advertisement.
Purchasing and Selling Vehicles and Homes
The For Sale By Veteran site is a vehicle and home listing and information service. For Sale By Veteran is not a party to any transaction between vehicle or home sellers and buyers. Information about a particular vehicle or home is supplied by the seller or home owner or Real Estate Brokerage or Real Estate agent. The terms of any transaction are, at all times, subject to direct negotiations between the buyer and the seller with respect to vehicles, and the buyer or renter and the home owner or Real Estate agent. For Sale By Veteran is not and will not be involved in negotiations.
Although we hope that all visitors to the For Sale By Veteran site will be honest, we cannot verify the information about vehicles/homes or guarantee the vehicles/homes offered by sellers.
We cannot guarantee the authenticity of any payment a seller of a vehicle or home may receive directly from a buyer.
Vehicle Purchases
The prices listed by sellers on the For Sale By Veteran site often exclude, without limitation, sales tax, finance charges, title, license, regulatory, dealer documentary, emission testing, and compliance fees, seller and buyer fees by For Sale By Veteran, LLC, any or all of which may be added to the listed price to arrive at the final sale price of a particular vehicle or home. It is the responsibility of the buyer to confirm the information that you read on the FSBV site. For Sale By Veteran is not responsible for, and does not guarantee, any vehicles, homes, goods or services listed or researched on the FSBV site. We may remove parts or all of a vehicle or home Advertisement on the For Sale By Veteran site at our sole discretion.
Vehicle Advertisements on FSBV may, at times, include vehicles that have been “certified” by dealers. Information listed on the For Sale By Veteran site as “certified” is provided by the listing dealer. For Sale By Veteran is NOT responsible for any information contained in a certified vehicle listing. The party responsible for purchasing the Advertisement, and only that party, is the party responsible for listing that vehicle as “certified. Ads purchased by Veterans/Active-Duty Military personnel will not appear as “certified” in any area of the For Sale By Veteran site. Ads for certified vehicles only apply only to vehicles certified by dealers.
Accepting a Cash Offer
Selling Your Vehicle to Buyer: If you decide to sell your vehicle to buyer, that buyer will be responsible for issuing you a check, when all applicable liens are released and lease obligations are met and the Buyer receives a clear and unencumbered vehicle title. All checks will be made payable to the vehicle owner(s) named on the vehicle title.
Ownership
The information on the For Sale By Veteran Site is the sole property of For Sale By Veteran, and is protected by U.S. copyright laws. You may not modify, display, reproduce or distribute any of the materials on the For Sale By Veteran Site without the prior written consent from For Sale By Veteran. All requests for permission should be sent to our Customer Service Director at customerservice@forsalebyveteran.com.
For Sale By Veteran and the For Sale By Veteran logo are owned by us and are trademarked. The names of any other companies referred to on the For Sale By Veteran site may be trademarked as well. You may not use any trademark or service mark appearing on the For Sale By Veteran site without the prior written consent of the owner of the mark.
If any provision contained in this agreement is, for any reason, held to be invalid, illegal, or unenforceable in any respect, that invalidity, illegality, or unenforceability will not affect any other provisions of this agreement, but this agreement will be construed as if the invalid, illegal, or unenforceable provisions had never been contained in it, unless the deletion of those provisions would result in such a material change so as to cause completion of the transactions contemplated under this agreement to be unreasonable.
The laws of the State of Georgia govern this Agreement (without giving effect to its conflicts of law principles).
If either Party employs attorneys to enforce any rights arising out of or relating to this Agreement, the losing Party shall reimburse the prevailing Party for its reasonable attorneys’ fees.
Termination
You agree that we may, under some circumstances and without prior notice to you, terminate your use of and access to any parts of the For Sale By Veteran site to which we restrict access, for example, by requiring registration. Some of the reasons for such termination may include, but are not limited to, (a) a breach or violation or suspected breach or violation of this User Agreement or other incorporated terms or guidelines, (b) a request by law enforcement or another government agency, (c) our decision to discontinue or change all or part of the For Sale By Veteran site, (d) technical or security issues, and (e) fraudulent or illegal activities. All terminations will be made in our sole discretion and you agree that we will not be liable for any termination of your use of or access to the For Sale By Veteran site or any part of the For Sale By Veteran site.
By using this service, you accept the terms of our User Agreement.
